Waiver of Counsel

This Waiver of Counsel is designed for use when one or more parties are advised to seek independent counsel, usually in contract or business situations. Frequently one party may be represented by counsel and the other may forego consulting with an attorney. In this case it is advisable to have a Waiver of Counsel which memorializes, in writing, that the opportunity to seek independent counsel was considered and then knowingly and voluntarily waived. Having a written Waiver of Counsel will protect both parties and ensure that the terms of the subject transaction are not undermined by a subsequent claim that one of the parties did not understand the legal ramifications of what he or she was signing.
