Waiver of Counsel (England and Wales)

In some contract situations one or both of the parties may be advised to seek counsel from an independent lawyer. This is especially important in situations where a party is waiving certain legal rights or one party is represented by counsel and the other is not. This Waiver of Counsel contains provisions which explicitly state that the opportunity to seek independent counsel was considered and then knowingly and voluntarily waived. A Waiver of Counsel protects both parties and ensures that the terms of the subject contract are not undermined by a later claim that a party did not understand the legal ramifications of what he or she was signing.
